Ben Nolan QC and Patrick Cassidy secure acquittal in a murder case heard at the Preston Crown Court

Congratulations are in order to Ben Nolan QC and Patrick Cassidy for their recent acquittal in a murder case heard at the Preston Crown Court before HHJ Cummings QC.

There was a successful submission of no case to answer before the trial Judge but the prosecution decided to appeal that ruling to the Court of Appeal and the following week the Court of Appeal rejected that appeal and declared the defendant be acquitted.

The point raised by the defence involved whether a defendant who may have involved himself after the killing blow may have been inflicted can ever be properly convicted of homicide. The defendant was a 26 year old archaeologist.

Criminal Barrister Patrick Cassidy speaking after the Courts decision reflected upon the great relief felt by all in what was a hugely taxing process for the defendant and his family.
