What Does This Seminar Cover?
You will learn best practices to help the position of the suspect.
This seminar will provide attendees with an understanding of the obstructiveness you may be met with at the police station, including how Police sometimes use differences in status to undermine advice given and push the suspect into positions they wouldn’t otherwise accept.
Waheed Baber will explain denial of access, the power to exclude a representative from the station, and how Police can delay access to a Lawyer, under the 1984 Police and Criminal Evidence Act (PACE) and the 2000 Terrorism Act (TA). He will cover the sections that detail how Solicitors can send an accredited representative to provide advice.
‘Representation at the Police Station: Part 2 (Dealing with the Initial Call & Action on Arrival)’ will detail what actions a Lawyer should take on arrival at the police station before seeing the client.
This seminar will go over a checklist of what notes to take from the custody record covering the grounds for arrest, grounds for detention, key times, documents, vulnerability, searches, interviews, samples, and risk assessment findings.
Learn the Custody Officer’s obligations, the documents that are essential to challenging the lawfulness of the arrest or detention, and what you should do with the information obtained from the Custody Officer. Waheed Baber will help you come to know the dangers that incomplete information can hold.
Discover what Lawyers should do if they suspect there to be phased disclosure of evidence to the client to try to make the client answer questions without knowing the full extent of the evidence. Find out how best to deal with a reluctance, or straight refusal, to disclose evidence.
